Classico Portraits – Terms & Conditions

By booking a photoshoot with Classico Portraits, you confirm that you have read, understood, and agree to these Terms & Conditions, including the cancellation and rescheduling policies.

1. Liability

The Client assumes all responsibility for themselves and any other subjects during the photoshoot, including any damage to property, personal injury, or illegal actions. The Photographer is not liable for accidents, injuries, or damages that occur during or as a result of the photoshoot.

If any subject causes injury to the Photographer or Client, or damages photography equipment, the Client is solely responsible for paying for all resulting injuries or damages promptly.

2. Booking & Payment

Booking Fee
The booking fee is $250 (or $250 of your voucher value), unless otherwise specified. It secures your photoshoot date and is non-refundable.

Artwork Credits / Bonuses
Any bonus artwork credits, if applicable, are applied to your final order during the Ordering Appointment.

Ordering Appointment
The Ordering Appointment must be held within 14 days of your photoshoot unless otherwise agreed.

Failure to attend the appointment, or scheduling it beyond 14 days, will result in forfeiture of both the booking fee and any bonus artwork credits.

Payment for Orders
All orders require a minimum 30% retainer at the time of order, with the balance due within 6 weeks unless otherwise agreed. Orders will not be sent to print until payment is received in full. All orders are final; cancellations result in a 100% cancellation fee.
An archive retrieval fee of $250 may apply for orders placed after the Ordering Appointment.

Additional Family Orders
After your Ordering Appointment, extended family or friends may order images through an online gallery made available for 48 hours. Orders after this period may incur a $250 archive retrieval fee.

Turnaround Times
Orders are processed only after full payment. Standard turnaround is 6–8 weeks, which may be longer during busy periods. No portion of an order will be delivered until payment is complete.

3. Prints, Digital Files & Pricing

Prints, digital files, or other products are not included unless specified. All items are available for purchase during the Ordering Appointment. Pricing is listed on our Artworks page.
Prices are guaranteed for 14 days following the photoshoot. Orders placed after this period are subject to the most current pricing. All prices include GST.

4. Cancellation & Rescheduling

Rescheduling
Clients may reschedule once at no cost if at least 7 days’ notice is given.
Reschedule requests within 7 days of the photoshoot result in forfeiture of the booking fee unless there are extenuating circumstances.
Additional reschedules or rescheduling outside these terms may incur a fee.

No-Shows
Failure to attend any scheduled appointment, including the photoshoot or Ordering Appointment, will be treated as a no-show. All monies paid are non-refundable.

Late Arrival
A 20-minute grace period is allowed for unforeseen delays. After 20 minutes, the photographer may treat the session as cancelled. Late arrivals may affect photo quality.

5. Photographic Materials & Copyright

All photographic materials, including digital files, negatives, proofs, and previews, remain the exclusive property of Classico Portraits.
By booking, the Client agrees to assign copyright of all images back to Kirstie McConnell of Classico Portraits and grants Kirstie McConnell of Classico Portraits the exclusive right to reproduce them.

6. Image Usage

Photographer Usage: Images will not be shared publicly without permission. Marketing use requires a signed model release.
Client Usage: Images are for personal use only unless a commercial license is purchased. Clients may not sell or authorise reproduction of images without a signed Usage License.

7. Artistic License

While many images are captured during the session, only the best that meet Classico Portraits’ artistic standards will be presented for selection. Clients are shown a minimum of 20 images to choose from, and will purchase only the images they love from that selection.

8. Failure to Perform

If the Photographer cannot perform due to illness, acts of God, or other uncontrollable events, a competent substitute photographer will be arranged. If a substitute is not possible, all monies paid will be refunded, and the Photographer has no further liability.

If photographic materials are lost, damaged, or otherwise unavailable without fault of the Photographer, liability is limited to the retail value of the Client’s order.

9. Exclusive Photographer & Session Conduct

Only scheduled subjects should attend the photoshoot unless otherwise agreed. Clients may not use their own camera, camcorder, or recording device, including phone cameras, during the session without prior permission from the Photographer.

10. Miscellaneous

This agreement contains the full understanding between the Client and Photographer which is binding, irrevocable, and worldwide.
Any modifications must be in writing and signed by both parties. Waivers of breaches do not constitute waivers of future breaches.
